Consumer Health Privacy Notice

Angel & Manna Bakery is a Massachusetts-based food establishment subject to the Massachusetts Retail Food Code (105 CMR 590.000) and the Massachusetts Food Allergy Awareness Law, which require food service establishments to maintain protocols for handling and disclosing allergen information. This Notice explains how we collect and protect health-related data you share with us. For customers in states with specific consumer health data laws — including the Washington My Health MY Data Act (MHMD) and Nevada Consumer Health Data Privacy Law — additional rights described below apply.

What Is Consumer Health Data?

Consumer health data refers to personal information that identifies or is reasonably linkable to a consumer and that a business collects in the context of a consumer's health. In our context, this may include:

  • Dietary restrictions and food allergies you disclose when placing orders (e.g., gluten intolerance, nut allergies, lactose intolerance)
  • Dietary preferences you select in your account (e.g., vegan, gluten-free)
  • Health-related notes you voluntarily include with your orders (e.g., "I have celiac disease")
  • Caloric and nutritional inquiries you make through our platform

We do not collect medical records, diagnoses, prescriptions, or clinical health information.

How We Collect This Data

We collect consumer health data only when you voluntarily provide it to us. This occurs when you:

  • Select dietary filters (vegan, gluten-free, nut-free) on our menu
  • Enter special instructions or allergy notes with an order
  • Set dietary preferences in your account profile
  • Contact us directly to ask about ingredients or allergens

We do not infer health conditions from your behavior and do not purchase health data from third parties.

How We Use Consumer Health Data

We use health-related information exclusively to:

  • Fulfill your order safely and accurately, including communicating your allergy information to our kitchen staff
  • Provide relevant product recommendations based on your stated dietary needs
  • Alert you to ingredient changes in products you've ordered before
  • Maintain records of allergy disclosures for food safety compliance

We will never use your health-related information for targeted advertising, sell it to third parties, or share it with insurers, employers, or any party not involved in fulfilling your order.

How We Share Consumer Health Data

We share health-related information only as follows:

  • Kitchen and production staff at Angel & Manna, on a need-to-know basis to safely prepare your order
  • Delivery partners, only to the extent of special handling instructions (never your health history)
  • Legal compliance, if required by a food safety investigation, court order, or applicable law

We do not sell, share for advertising purposes, or otherwise disclose your health-related information to any other party.

Massachusetts Food Allergy Compliance & Allergen Disclaimer

Angel & Manna Bakery complies with the Massachusetts Food Allergy Awareness Act and 105 CMR 590.000, which require food service establishments to:

  • Post food allergy awareness information in the food preparation area
  • Ensure that trained staff are available to answer questions about ingredients and allergens
  • Follow proper protocols to minimize cross-contact for customers with disclosed allergies

While we make every effort to accommodate dietary needs and allergen requests, our kitchen is not a certified allergen-free facility. We handle the nine major food allergens — wheat, dairy, eggs, tree nuts, peanuts, soy, fish, shellfish, and sesame — on a daily basis. Cross-contact is possible. If you have a life-threatening allergy, please contact us directly at (617) 555-0120 before ordering so we can discuss your needs with our head baker. Customers may also reference our Allergen Information Guide, available in-store or by request.

If you believe your allergen disclosure was mishandled, you may also file a complaint with the Massachusetts Department of Public Health or your local Board of Health.

Your Rights Regarding Health Data

You have the right to:

  • Access the health-related information we hold about you
  • Correct inaccurate health information in your account
  • Delete your health-related data — you may update or remove dietary preferences and allergy notes from your account at any time, or contact us to request deletion
  • Withdraw consent for collection at any time by removing preferences from your profile or contacting us

To exercise these rights, contact privacy@angelandmanna.com. We will respond within 45 days. Massachusetts residents with concerns about unfair or deceptive data practices may also contact the Massachusetts Attorney General's Office under M.G.L. c. 93A.

Data Security for Health Information

Consumer health data is treated with the highest level of care within our organization. Access is restricted to personnel who require it to fulfill orders. We do not retain allergy notes beyond the completion and delivery of the relevant order unless you have saved preferences in your account profile.
