By accessing or using the Angel & Manna Bakery website, mobile application, online ordering system, or any related service (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you and Angel & Manna Bakery LLC, a Massachusetts limited liability company ("Angel & Manna," "we," "us," or "our").

You agree to use our Services only for lawful purposes and in a manner consistent with all applicable local, state, and federal laws. You may not:

• Use the Services to engage in any fraudulent, deceptive, or harmful activity
• Attempt to gain unauthorized access to any part of the Services or our systems
• Transmit viruses, malware, or other harmful code
• Scrape, crawl, or use automated tools to access the Services without our written permission
• Impersonate any person or entity or misrepresent your affiliation
• Post or transmit any content that is defamatory, obscene, or violates the rights of others

Order Acceptance: Placing an order through our Services constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or suspected fraud. You will be notified promptly if your order is declined.

Pricing: Prices displayed are in U.S. dollars and are subject to change without notice. All prices are exclusive of applicable taxes, which will be calculated at checkout. Delivery fees, if applicable, will be shown before you complete your order.

Payment: We accept major credit cards, debit cards, and gift cards. Payment is processed at the time of order. By submitting payment information, you represent that you are authorized to use the payment method provided.

Cancellations and Modifications: Orders may be canceled or modified within 30 minutes of placement. After that time, due to our fresh-baked production schedule, cancellations may not be possible. Please contact us immediately at (617) 555-0120 if you need to change an order.

Massachusetts Sales Tax: Most food products sold by Angel & Manna Bakery qualify for Massachusetts' food sales tax exemption under M.G.L. c. 64H, §6(h). However, certain items — including prepared hot food, candy, and certain packaged goods — may be subject to the 6.25% Massachusetts sales tax. Applicable taxes will be clearly itemized at checkout.

Food Safety and Allergen Disclosure: Angel & Manna Bakery operates in compliance with the Massachusetts Retail Food Code (105 CMR 590.000) and maintains food allergen awareness protocols as required by Massachusetts law. Our kitchen handles common allergens including wheat, dairy, eggs, tree nuts, peanuts, and soy. We are not a certified allergen-free facility and cross-contact is possible. Customers with life-threatening allergies should contact us at (617) 555-0120 before ordering. We comply with Massachusetts food labeling requirements for packaged goods sold on-premises.

Participation in the Angel & Manna Rewards program is subject to program terms available on the Rewards page. Points have no cash value, are non-transferable, and may expire after 12 months of account inactivity. We reserve the right to modify or discontinue the program at any time with reasonable notice.

Angel & Manna gift cards are issued in U.S. dollars and do not expire. Under Massachusetts law, gift card balances may not be reduced by inactivity fees. However, pursuant to the Massachusetts Abandoned Property Law (M.G.L. c. 200A), unclaimed gift card balances may be considered abandoned property after three (3) years of inactivity and remitted to the Massachusetts State Treasurer as unclaimed property. You may reclaim abandoned property from the Massachusetts State Treasurer at mass.gov/unclaimed-property.

Gift cards are redeemable for cash in Massachusetts if the balance is $5.00 or less, as required by M.G.L. c. 200A. Lost or stolen gift cards will not be replaced without adequate proof of purchase. We are not responsible for unauthorized use of gift card codes.

All content on our Services — including text, images, logos, recipes, branding elements, and software — is the property of Angel & Manna Bakery or its licensors and is protected by U.S. and international copyright, trademark, and trade dress laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our Services without our express written permission.

If you submit reviews, photos, or other content to our Services, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and distribute that content in connection with our Services and marketing. You represent that you own or have the right to share such content and that it does not violate the rights of any third party.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. TO THE FULLEST EXTENT PERMITTED BY LAW, ANGEL & MANNA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANGEL & MANNA BAKERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Massachusetts Consumer Protection Act (M.G.L. c. 93A): Nothing in these Terms is intended to limit or waive any rights you have under the Massachusetts Consumer Protection Act, which prohibits unfair or deceptive acts or practices in trade or commerce. If you believe we have engaged in an unfair or deceptive act, you may send a written demand for relief to us at the address below at least 30 days before filing suit. Willful or knowing violations may entitle you to up to three times your actual damages, plus attorney's fees, under Chapter 93A.

Dispute Resolution: We encourage you to contact us directly to resolve any dispute. Most concerns can be addressed by calling (617) 555-0120 or emailing legal@angelandmanna.com. For unresolved disputes, you may also contact the Massachusetts Attorney General's Consumer Protection Division at (617) 727-8400 or mass.gov/ago.

For disputes not resolved informally, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules will apply, except that either party may seek emergency injunctive relief in a court of competent jurisdiction in Worcester County, Massachusetts. Any class action waiver contained herein is subject to applicable Massachusetts law, and nothing herein is intended to prevent you from bringing a claim under M.G.L. c. 93A.

We may revise these Terms at any time. We will post the updated Terms with a new effective date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
